Can I get a divorce in WI if my husband refuses to sign papers? My husband has been incarcerated for four years. I filed for divorce through the court on my own without a lawyer. He has already been served papers and I have already attended the temporary hearing. The court commisioner informed me that once my husband signed the remaining papers and I filed them with the court I would then be givin my final court date, however my husband refuses to sign and I cannot afford an attorney. Can I get a divorce without his signature? Please help! Every year my taxes are taken for his back child support and I dont want to wait another year. I just want this nightmare over!!!!!! |

If you have filed as a single person they cannot take your incom tax for his back child support. If you have been filing jointly then that would explain why their taking it. So I would not file jointly. Your husband has to be served it does not mean he has to sign for the divorce. The purpose of his being served is to let him be aware that your asking for the divorce. You could be eligiable for free legal services and you can get the number from social services or in the phone book. It is called legal Aid. They go by your incom and since your not making alot you may qualifly. I got a divorce from my husband he was served but he did not sign the papers. It is easierl when you have an attorney,exspeciaaly if you knew he was not going to sigh. The judge always works better with the lawyers,than without.
