Child Support Information re: Non-custodial parent relocating to MS; custodial parent remaining with child in GA.

I am currently considered the non-custodial parent in my petition for divorce in White County GA. My soon-to-be ex-husband has filed for divorce in my county since I did not have money for an attorney. Due to financial hardship, I have decided to return to my hometown in MS. The divorce will not be final until 1/15/08, which is also the date I plan to move back to MS. The custodial parent, father, will be remaining with our son in GA. What should I do about child support? The calculators I've found online have given a wide range of costs. I know my income will be reduced in MS, but so will the cost of living. Ideally, I would love to have custody of my son, but I don't have the funds to fight that in court. Any information and insight you may be able to provide is greatly appreciated.

In Mississippi, your child support for one child will be about 14% of your gross income according to state law passed in 1972. You don't necessarily need a lawyer if you want to retain custody of your son. You will go to a custody hearing to set up a fromal custody agreement and the judge will determine the best solution for your son. If you believe he would be better moving with you, you can certainly tell the judge why. Most of these situations are subjective because every situation is different. Good luck!

Well regardless of where you live if you give your spouce custody then you will be as responiable to pay child support just as he would if you had the custody. You can ask for joint custody and get your child for the summers,being that your moving so far away. Child support is based on your incom usally 25% of your incom before taxes.

Ah yes, the evil exhusband... I went through this myself with my ex... They should base it on your income... and try to get SHARED PARENTING! i now have custody of my son, i didn't then, so with shared parenting, neither of us have to pay support ever.. it sucks now, i want him to pay, but because it's shared, he doesn't have to and the other way around. This also is good because the farthest you will have to travel to pick up or drop off is half way!

I would think you would have your son and he would pay support unless there are other reasons you are leaving him in GA
