Could my husband falcificate my signature to sell, transfer, alter the Deed of our House and Lot? My husband and I had disagreement last December 2011. He was about to move and wanted to file a divorce but changed his mind to stay. Today, I discovered that the Deed of our house is missing including the Title from Escrow Company and other important papers. He denied he took them out from our safekeeping. He doesn't like the Title Insurance stating "Community Property With Right Of Survivorship". If in case my husband have the original papers, how do I prevent him from selling, transfering or changing the content of our Deed. How if he fake my signature? How do I protect my rights to that house? |

Whether or not your husband moved the paper work is not very important. This papers are generally filed with the county in which you live. If he forges your signature in the hopes of selling the property, he has committed fraud with the intent to harm you. This type of fraud carries a potential sentence in prison as it is a felony. You could have a real estate license holder (an agent or a broker) check the status of your property on a weekly or on a monthly basis - he/she will check with the county to see if there has been an legal changes in the property and he/she can check the local real estate listings to see if the property is listed for sale. Most agents or brokers (try to find a smaller real estate company) will do this work for a minimal fee, say $15.00 or $20.00 a month. Again, your husband having the deed and title work has little, if any, real purpose as there are many legal steps necessary before anything can be changed.

His having a physical copy of the deed or other paperwork won't make forging your signature something that you have no recourse over.
Since he's seemingly being deceitful over the entire issue of your missing documents, you may as well go ahead and file for divorce and get it over with, and tell him why. Then call your county registrar of deeds and ask for new copies as yours seem to have been misplaced.

I would not be overly worried ,as if you see anyone coming to view the house etc, then you can put them off by stating that you are the owner and that it is a hoax. I would then get yourself off to the police station and report your husband for Fraud.
I fail to see why you are with this man at all, why are you letting him decide what he wants? Take control of your own life.
The advice from IMHO is great and I would listen to her.
