Divorce laws when domestic violence is a factor If a woman was in an abusive marraige and wants to file for a divorce are there any laws that can help her expidite it. She came here to California where her family is to help her but has only been a resident for 4 months. She is affraid that the husband is going to come here and hurt her. She comes from Texas. What is the quickest fastes resolution to a situation as such. She was told she needs to be a resident for six months first. Is there any way around this in this type of situation? He has made threats on her and all her family members so we need help asap.... Thank you for your answers to this question.... |

You do have to be a resident for 6 months. However if he threatens you or comes near you and trys anything call the police and get a restraining order. Just make sure you stay close to your family. As soon as the 6 months is up go file for the divorce. You can either call legal aide and try to get free legal services,they go incom. You can also go on line an to free legal forms and down load and fill out and file with the court. You can also down load a wavier for payment to file and court cost,they also go by incom. The wavier and the divorce forms will have to be filed together. You can go ahead and fill the forms out just don't dtae them and they will be ready to file when the 6 months is up. I wish it could be quicker but each state has their laws.
