Husband just left after 9 years

My husband has left me and our two sons after 9yrs. I have some proof that it is because of another woman (I have copies of text messages from his phone from the other women). How can I get him to continue to pay for the bills (Mortgage, insurance, daycare, etc.) that he has been paying since we moved into our home (now 2yrs in the home) before will officially file for separation/divorce? What would be his responsibility for child support? How can I obtain funds to hire a divorce attorney since I cannot apply for a loan from my 401k without his signature on the application since we are still legally married?

Talk to a divorce attorney anyway. Talking is free, and I'm sure any good one would take your case and not take any money from you until after your finances had been settled in court.

Divorce is tricky but if you have proof of the infedelity then take that to a lawyer and find out if you get anything. you maybe able to get 9 years worth of his 401k that may help with legal bills. as for the bills, pending the childrens age you can get support from him but as for the house and all you may have to split the costs and eventually you will have to take over payments because the courts now-a-days expect the women who don't have infants to be working some. always talk to a lawyer though. also i may cut court fees down not sure if its alot or not but try for a settlement or have a mediator give his opinion on what the split and payments should be. you don't have to take that decision from him but he can guide you in the right direction for a fair divorce.
