I have been married to my husband 5 years, he wants a divorce after i am unemployed.

We have been married for more than 5 years. He didn't want me to work. So I quit my job couple monthes ago, now, because his daughter (who is 20) from his first marriage keep asking him money and he sends her thousands of dollars for buying new car and also rentals.... now when I ask him money, he keeps telling me that he has no money, and he wants a divorce. He has one home based business, and I have a daughter (who is 12) from my first marriage So what should I do? If he insist to have a divorce lawyer, what can I get. My daughter loves him though......

You haven't been married long enough to get spousal support and you have no children together so this is a easy case. Your not going to get anything so I wouldn't bother with a lawyer look for a good new job till you get one and take your daughter and leave.

You've been married for 5 years, that is enough time to allow you to be eligible for alimoney. Hire yourself an attorney at his expense or you will likely qualify for public assistance. Many attorneys will work at a reduced rate depending on your income. You are also entitled to a portion of any retirement he may have and any savings, stocks etc.
Him encoraging for you to quit your job and then request a dvorce was a dirty deal.
You must find a lawyer though, if he has representation and you don't, you will be conveniently urged to take whatever deal he makes and it won't be in your best interest.

Thanks for your answers! I live in Colorado, I heared that maybe everything you have here after married is 50%for wife and 50%for husband. But I am not sure if it is true for housing,his savings and business because he owns all of them under his name. Does the marraige year matter when you file a divorce? How much? Should I get a divorce attorney first or wait for him to divorce me? He told me he filed divorce for his first marriage, and got everything. I don't really have any experience because my first marraige was not in U.S. But I am a citizen here.

Thanks for sending me the website link. It is a great help! Divorce is quite complicated and very much in detail too. Before our marriage, he had a very big savings and he told me that was from his grandparents. During our marriage, his father passed away, so our house has been paid off from his father's money which he inherited from...... So I think maybe I shouldn't get anything..... like he said, those money are all not his.....
