Raising child support I am paying child support in NC and is current. I can afford to continue paying without any problems. I am 1 year into a chapter 13 and found out my ex wife requested a review in child support. I cannot afford to pay anymore than I do for my 15 1/2 year old. I have 2 other kids in a different state that I pay support for. My child in NC receives almost triple the amount I pay for the others. I also have 3 step children living with me that I take care of. In my divorce decree it states that both parents are responsible for medical and dental for my child in NC. I am the only who have any insurance on her. Can my support be raised? |

She can try but you have to be willing to go back to court. come prepared, bring everything that you can to prove that you will be is serious financial hardship if she requires an increase in your chld support. You have to defend your case, or give everything you can to your attorney and have it go that way. if you do win your case and you dont have to pay more have it in your statement that you want her to pay for your court fees because it was her decision to go back to court in the first place. but remember you have to be prepared, come up with everything that you can to show how difficult of a hardship paying more would be... use her finances if you can. prove that she doesnt need more.

it works like this, she asks for review, ch sup sends both parents out financial info paperwork, you fill out & send back to them, they usually have hearing w/out u there, notify u of outcome, & then before it goes into effect you have right to appeal. so if she wins, you can go in & plead your case.
