Washington state divorce law and children

I moved (with my husband's knowledge) to Nebraska 2 months ago. Can I file for divorce in Washington state or have the children been out of the state too long for me to do this?

We were Washington residents and he still resides there.

You have to be a current resident and meet the residency requirement of that state. either he can file in WA or you will have to wait until you meet NE residency requirements.

One more question then, if he files in Washington, would I get an attorney in Washington to represent me or one in Nebraska? Thank you.

You will have to get an attorney there, and the laws of Wasington will apply , then you will have to have your case tranfered here , on and on
Just wait until you are resident in NE; during your divorce, child custody, child support and parenting plan have to be submitted, it will cost you a fortune to litigate that in WA. It is best that the jurisidction of the custodial parent and children be used anyway. NE has no fault divorce and are middle of the road on everything, he would be assured of a fair outcome in NE. If you two can agree on everything, you may save the cost of one atty.
