Question

Asked 3/10/2010

What can I do about this

My ex-wife has claimed our children on taxes for the past two years. The divorce decree states that they are my dependents to claim. I have to keep waiting for this to be straightened out each year. Is there a way I can keep this from happening.

Not really, the IRS may eventually disqualify her from claiming the EIC, but it won't proactivly prohibit her from listing them as dependents.

You could always take her to court for contempt, maybe if the judge reminds her of your agreement she'll realize she needs to stop.
