Wrongful use of dependants

My ex husband for the last 5 years has not paid child support. He has claimed the children and violated our divorce court documents by doing so. Is there anything that can be done for him using the kids as dependants. he also used my son as a dependant, not his biological child, after we were divorced.

You'd have to take him back through the courts, as he is violation of the divorce agreement.

If you have enough income to file a tax return, you can also file claiming the children. You would have to mail it in. The IRS would write asking you both to prove where the children lived. Whoever could provide proof would be allowed to keep the dependencies.

Next year, file your taxes while claiming the children before he does. When claiming dependants, it goes off their social security number. if they number was already use, he then can't claim them.

So, file y oru taxes as quickly as possible. When he goes to efile his, it will be bounced back with a "used depenands SS #".
